DMCA Policy

unlocky.io LLC (“unlocky.io”, “Company”, “Platform”) operates a link-in-bio tool available at www.unlocky.io (the “Site”). The Site enables independent creators (“Creators”) to create a personal link-in-bio page that collects and displays links to their content and profiles, which users and visitors (“Users”) can browse. unlocky.io provides the page-hosting and link-sharing tools described in these terms.

unlocky.io LLC qualifies as a “Service Provider” within the meaning of 17 U.S.C. § 512(k)(1) of the Digital Millennium Copyright Act (“DMCA”). We respect the intellectual property rights of others and comply with the DMCA. This Policy explains how to submit notices of claimed copyright infringement, how to submit counter-notices, and how we handle repeat infringers.

1. Designated Copyright Agent

Please mark all DMCA notices with “DMCA Notice” in the subject line. For counter-notices, please mark with “DMCA Counter-Notice”.

2. Notice of Claimed Infringement

To be effective under the DMCA, a notification must be a written communication provided to our Designated Agent that includes substantially the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works;
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (including specific URLs);
  4. Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an email address;
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Counter-Notice Procedure

If you believe that material was removed or disabled as a result of mistake or misidentification, you may submit a counter-notice to our Designated Agent containing substantially the following:

  1. Your physical or electronic signature;
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled;
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
  4. Your name, address, telephone number, and email address;
  5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which unlocky.io LLC may be found), and that you will accept service of process from the person who provided the original notification or an agent of such person.

4. Response Timelines

We strive to acknowledge receipt of DMCA notices within two (2) business days. Upon receiving a valid notice, we will expeditiously remove or disable access to the allegedly infringing material and notify the affected user. If a valid counter-notice is received, we will forward it to the original complainant and, absent notice that a court action has been filed, restore the material within ten to fourteen (10-14) business days.

5. Repeat Infringer Policy

It is our policy to terminate, in appropriate circumstances, the accounts of users who are repeat copyright infringers. We may also terminate accounts based on a single egregious infringement. We reserve the right to define “repeat infringer” in our sole discretion based on the number, severity, and pattern of notices received.

6. False Statement Consequences

Any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees, under 17 U.S.C. § 512(f). We reserve the right to seek all remedies available at law and in equity for any such misrepresentation.
